Malaysia: Government risks undermining democratic progress, say UN experts

GENEVA – UN human rights experts* on Monday expressed their dismay at the use of tear gas and water cannons by security authorities against peaceful protestors in Malaysia on Saturday, reportedly leading to injuries and one death, and the arrest of more than 1,600 people at the Bersih 2.0 rally.

“The right to freedom of opinion and expression, including in the form of peaceful protests, is essential for democracy. By declaring the demonstration illegal, sealing off parts of the capital in advance and responding in such a heavy-handed manner against peaceful demonstrators, the Government of Malaysia risks undermining democratic progress in the country,” said Frank La Rue, UN Special Rapporteur on the right to freedom of opinion and expression.

Tens of thousands of people gathered near the Medeka Stadium on Saturday despite the announcement made by the police that no gathering would be permitted that day on the basis of the Malaysia Police Act, which requires organizers of public gatherings of three or more persons to seek permits beforehand. The protests were called by Bersih, a coalition of more than 60 non-governmental organizations seeking to promote free and fair elections in Malaysia.

“Actions taken by the authorities prior to and during the rally unduly restricted the rights to freedom of expression, assembly and association,” said La Rue. “Declaring Bersih illegal based on claims that it is trying to topple the Government or is a risk to national security and public order – in the absence of any credible evidence to substantiate such claims – is also an unnecessary restriction of civil and political rights.”

According to Malaysian police, all of those arrested on Saturday have been released. But the UN experts noted that six leaders from the Socialist Party of Malaysia reportedly remain in detention. These individuals include Michael Jeyakumar Devaraj, Sukumaran Munisamy, Letchumanan Aseer Patham, Choo Chon Kai, Sarasvathy Muthu, and Satat Babu Raman.

“We remain deeply concerned about the detention of six individuals since 25 June under the Emergency Ordinance, which allows for detention without trial for up to 60 days,” said El Hadji Malick Sow, Chair-Rapporteur of the Working Group on Arbitrary Detention.

The Working Group on Arbitrary Detention also reiterated its recommendation, made to the Government of Malaysia following a visit to the country in June 2010, to repeal the Emergency Ordinance and other preventive laws, on the grounds that they significantly hinder fundamental human rights, such as the right to fair trial.**

The independent experts reminded the Government of Malaysia of its obligation to fully respect the rights to peaceful assembly, association, and expression, as guaranteed under the Federal Constitution and the Universal Declaration of Human Rights. They also recalled that as a member of the Human Rights Council, Malaysia has pledged to uphold the highest standards in the promotion and protection of human rights.

“Malaysia, as a dynamic, multi-ethnic, multi-cultural and pluralistic nation, should remain open to legitimate political discourse on democracy, including the expression of dissent,” the experts said. “We urge the Government to allow all individuals to enjoy their human rights, and to address the problem of preventive detention. Likewise, we call upon the Government to ensure that there will not be any punitive measures taken against peaceful demonstrators.”

Seseorang perlu berUNDUR…

Kita ada pilihan nak laksanakan yang BERSIH atau nak kekalkan yang KOTOR.

Benchmark pihak berkuasa ialah Demonstrasi mesti digagalkan walau apapun terjadi.  Justeru, pelbagai tindakan termasuk ugutan telah dilakukan secara suka dan paksa.  Malah siap ada “klip” yang keluar di TV menghalang orang untuk turut hadir.  Malah ada “terompah kayu” yang mereka “khutbah” yang senada dengan “klip” di TV untuk membodohkan jemaah di Masjid.

Hakikatnya, semua pihak yang terlibat untuk membatalkan demo ini telah gagal:-

1.  FRU – tanpa unit lain, termasuk Unit Udara, Unit Trafik, Unit Kuda, Unit Anjing, VAT 69, Forensik… kome tak leh nak buat apa…  FRU gagal untuk kawal situasi – memalukan…

2.  MEDIA ARUS PERDANA – Kena hantar wartawan yang boleh mengira dan ada otak sikit.  Bila jalan dah kena blok dengan Polis – memanglah lengang dan takde orang di atas jalan. Cari makan pun biarlah ada integriti dan bukan membuta tuli.

3.  NGO NYAMUK – Berdengung-dengung bunyi sebelum demo, masa demo tu hilang langsung tak dengar habuk pun.

4.  Pengerusi & Timbalan Pengerusi SPR – Korang sure kena resign.  Sebab gagal memahami aspirasi rakyat.  You are paid to serve the people and the country.  You are not paid to speak on behalf of any leaders…

5.  Ketua Polis Negara – Tuan kena LETAK JAWATAN.  Tuan gagal MENGHALANG DEMO dan tuan juga telah gagal MENGAWAL KEAMANAN.  Tuan tak pernah didik anak buah untuk beradab dan berakhlak ke?  

6.  UMNO – berhimpun dan duduk atas kerusi empuk di PWTC tidak menyelesaikan masalah rakyat jelata dan penipuan dalam pilihanraya – jumlah yang duduk dalam dewan PWTC tak boleh tanding jumlah peserta BERSIH.  Kehadiran peserta PWTC pastinya dipaksa dan boleh claim.  Peserta BERSIH datang dan sedia untuk menanggung risiko.  Tak ada sesiapa yang akan bayar claim dan elaun.

Si Kuning yang bakal ditangkap

Kecoh betul, habis semua benda warna kuning nak kena tangkap.  Mamat ni sekarang dalam ketakutan dan tak tentu arah.  Sapa boleh tolong dia?

Hak untuk berhimpun adalah hak asasi rakyat disebuah negara yang mengamalkan demokrasi.

politik terdesak barisan nasional di bagan pinang

1.  Mula-mula BN kata orang PAS yang pukul Dato’ Azeez Putera.  Bila kita minta gambar sebagai bukti, takde gambar tetapi tiba-tiba je gambar Azeez Putera tengah terlantar di hospital dengan lehernya bercorong…. hahahahah murah sangat politik nie… nasib baik “orang” tu tepuk je… kalau dia ludah kat belakang Dato’ Azeez… tak tahu lah jadi nanah ke kurap kat situ.

2.  Petugas PAS diserang oleh budak-budak pencacai BN yang sedang mabuk.  Kita tahu dalang disebalik budak-budak nie, ini semua budak BN dari luar – tapi mesti ada baruah yang bawa dan arahkan mereka… pengecut, sembunyi belakang pokok.

3.  Bendera Pakatan selain PAS semuannya diturunkan atas alasan hanya PAS yang bertanding… tapi bendera Umno boleh naik disamping bendera dacing padahal bukan logo umno yang akan diguna atas kertas undi!   Inilah undang-undang bendul bila sprm hanya menjadi lembu yang dicucuk hidung sahaja… adalah maruah sikit walaupun tak banyak…

4.  Ketiadaan POLIS yang ramai menjadi tandatanya yang semakin terjawab – ianya seolah-olah dirancang dan disengajakan untuk menjadi alasan kepada berlakunya ketegangan dan kekasaran dan pergaduhan tanpa perlu POLIS datang untuk meleraikan atau mencegahnya… semacam “jenayah terancang” dan pastinya ada niat jahat disitu… Menteri Dalam Negeri perlu bertanggungjawab.

Nurin post-mortem pix – “Not Enough evidence to charge cops”

NOT A SURPRISE AT ALL.  “RAKYAT DIDAHULUKAN”.

They are busy looking into Khir Toyo’s threat letter… trying to do all these forensic things…. but matter that involved rakyat and commoners are left untouched.  Two photographers, still alive yet no one can be blame?

Do they think Malaysian can be fool always – again and again?…

Just give a thought, put yourself in Jazimin (Nurin father) shoes and what you feel now?  Being screwed by your own authority, not only they failed to locate the girl, they cant even captured the killer, they have evidence but couldnt get any clue, and lastly, their man made public something considered PnC and sensitive but they are above the law.

In this manner, we are not far behind from the regime of Myanmar, maybe at par.

KUALA LUMPUR: The two policemen identified as the culprits behind the circulation of Nurin Jazlin Jazimin’s post-mortem photographs will not be charged.

Attorney-General Tan Sri Abdul Gani Patail told the New Straits Times that there was insufficient evidence against the two.

“I have looked into Nurin’s case file and found that it was going to be difficult to charge the two policemen as there was insufficient evidence,” Gani said.

He said it was difficult to prove who took the photographs and when they were circulated.

“We’re in the digital era now. Photos can be manipulated and unless you catch the person in the act or there are witnesses who can testify, it would be quite difficult to charge a person.”

The two policemen will continue with their duties.

In a NST report yesterday, Federal Criminal Investigations Department deputy director I (intelligence and operation) Datuk Mortadza Nazarene said that disciplinary action had been taken against one of the policemen.

The policeman was removed from the CID and assigned to desk duties. Mortadza added that the disciplinary unit was still investigating the second policeman.

Nurin, 8, was abducted, sexually abused and found dead two years ago.

Days after her body was found in a sports bag outside a shoplot in Petaling Jaya, post-mortem photographs of the victim were circulated on the Internet.

The photographs also showed a brinjal and a cucumber shoved into her private parts.

Nurin’s father Jazimin Abdul Jalil, sued the police for negligence after the photographs became public.

Jazimin is seeking an unspecified amount in general, exemplary and aggravated damages, interest, cost and other relief deemed fit by the court.

Jazimin, 35, told the NST recently that he had received a letter, dated Aug 3 from the Attorney-General’s Chambers, informing him that two policemen had been identified as the culprits behind the circulation of the photographs.

The letter was signed by the chamber’s prosecution head, Tun Abd Majid Tun Hamzah.

Jazimin also complained that he was kept in the dark over the progress of investigations.

Gani said the public should visit the website, http://www.agc. gov.my, to refer to files that the chambers received and follow case progress.

Nurin, a Year Two pupil of SK Desa Setapak, was abducted some 500m from her house in Wangsa Maju here on Aug 20, 2007. Her body was found two months later.

No one has been charged with the murder.

Nafi tolak Chuan How jatuh

KUALA LUMPUR 16 Ogos – Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) hari ini menafikan dakwaan mereka menggunakan kaedah gestapo semasa menahan Wong Chuan How, pembantu khas kepada seorang daripada Exco kerajaan negeri Selangor, pada Jumaat lepas.

“Adalah ditegaskan bahawa pegawai SPRM tidak pernah sama sekali menolak Wong (Ahli Majlis Perbandaran Sepang) sehingga beliau jatuh. Kecederaan yang dialami oleh Wong tidak akan berlaku sekiranya beliau mematuhi arahan yang telah diberikan dan memberikan kerjasama sepenuhnya bagi menyempurnakan siasatan yang dijalankan,” menurut SPRM dalam satu kenyataan yang dikeluarkan di sini hari ini.

SPRM berkata, siasatan awal mendapati beberapa program dan bantuan yang menggunakan peruntukan pembangunan Anggota Dewan Undangan Negeri Sungai Pelek telah tidak disampaikan kepada pihak pemohon walaupun kelulusan telah diberikan dan cek-cek telah diserahkan kepada Wong.

“Penemuan hasil siasatan ini menjadikan Wong sebagai suspek utama dan keputusan dibuat agar beliau ditangkap untuk siasatan lanjut, dan untuk itu SPRM pada 5 Ogos telah berusaha menghubungi Wong melalui panggilan telefon serta khidmat pesanan ringkas (SMS) ke telefon bimbitnya tetapi tidak dibalas.

“Akhirnya, pada 13 Ogos 2009, Wong telah menghantar khidmat pesanan ringkas kepada pegawai SPRM memaklumkan bahawa beliau bersetuju untuk bertemu dengan pegawai SPRM di Pejabat Pusat Khidmat Masyarakat ADUN Sungai Pelek pada 14 Ogos 2009 jam 9 pagi,” kata SPRM.

Pada hari Jumaat lepas, sepasukan pegawai SPRM telah bertemu dengan Wong berserta dua peguamnya di tempat yang dijanjikan dan pegawai SPRM telah menunjukkan kad kuasa SPRM kepada mereka bertiga.

“Beliau (Wong) telah dimaklumkan bahawa beliau perlu dibawa ke Pejabat SPRM Putrajaya bagi tujuan siasatan lanjut kerana dokumen-dokumen berkaitan kes yang sedang disiasat berada di Ibu Pejabat SPRM,” katanya.

SPRM berkata, Wong dan kedua-dua peguamnya membantah kerana dikatakan Wong terikat dengan Pekeliling Setiausaha Kerajaan Negeri Selangor Bil. 4 Tahun 2009 dan lanjutan daripada keengganan tersebut, Wong telah ditangkap oleh pegawai SPRM berhubung kesalahan di bawah Seksyen 18 Akta SPRM 2009 dan Seksyen 406 Kanun Keseksaan.

“Wong juga seterusnya enggan menurunkan tandatangannya apabila notis di bawah Seksyen 53 (3) Akta SPRM 2009 dibaca dan diserahkan kepada beliau,” katanya.

Beliau berkata, Wong melalui peguamnya meminta pegawai SPRM membenarkan beliau pergi ke balai polis untuk membuat laporan polis berhubung tangkapan ke atasnya sebelum beliau mengikut pegawai SPRM ke Putrajaya.

Pegawai SPRM bersetuju dan memaklumkan bahawa Wong adalah di bawah pengawasan SPRM dan beliau perlu menaiki kereta pegawai SPRM untuk ke balai polis.

Kata SPRM, apabila Wong yang tidak digari hendak dimasukkan ke dalam kereta pegawai SPRM yang sudah pun menunggu di luar pusat tersebut, beliau secara tiba-tiba menepis tangan pegawai SPRM yang mengiringi beliau dan cuba melarikan diri.

“Pegawai SPRM terpaksa mengambil tindakan menghalang Wong dari melarikan diri dengan memeluk beliau dari belakang kerana beliau mula meronta-ronta dan akhirnya menjatuhkan dirinya di atas lantai kaki lima deretan kedai di situ.

“Adalah ditegaskan bahawa pegawai SPRM tidak pernah sama sekali menolak Wong sehingga beliau jatuh,” katanya.

Dengan itu SPRM memohon kerjasama orang ramai untuk memerangi jenayah rasuah dan bukannya memburukkan SPRM dengan mengeluarkan kenyataan melulu berasaskan kepada sentimen semata-mata. – BERNAMA

SATU Malaysia pun tak akan percaya dengan versi SPRM nie…

Tapi mungkin ada dua tiga NGO’k akan sokong – siap buat banner lagi – pakai lilit-lilit kat kepala sokong SPRM nanti – hahahaha… dapatlah nasi lemak dengan teh ais sorang sebungkus… JADILAH…
